These Terms of Service govern your use of the Little Haven Australia website and your purchase of products from us.

Throughout these Terms, “Little Haven Australia”, “we”, “us” and “our” refer to Little Haven Australia. “You” and “your” refer to the person accessing our website or purchasing products from us.

By accessing our website, creating an order or purchasing a product from us, you agree to these Terms of Service, our Returns and Refunds Policy, Privacy Policy and any other policies displayed on our website.

1. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified.

Where there is any inconsistency between these Terms and your rights under the Australian Consumer Law, your rights under the Australian Consumer Law will apply.

2. Eligibility to Purchase

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to place an order through our website.

By placing an order, you confirm that:

  • The information you provide is accurate and complete.

  • You are authorised to use the selected payment method.

  • You have reviewed the product description, dimensions and delivery information.

  • You agree to pay the total amount shown at checkout.

You must not use our products or website for any unlawful or unauthorised purpose.

3. Product Information

We make reasonable efforts to ensure that product descriptions, measurements, photographs, colours, features and prices are accurate.

However:

  • Product colours may appear differently depending on lighting, photography and screen settings.

  • Timber and timber-look products may have variations in grain, colour, texture and finish.

  • Product measurements may have minor manufacturing tolerances.

  • Packaging may differ from photographs shown on the website.

  • Product specifications may be updated by the manufacturer.

These minor variations are not necessarily product faults where they do not affect the product’s safety, function or overall quality.

Customers are responsible for checking product dimensions, room access, doorway measurements and available space before purchasing.

Please contact us before ordering if you require clarification about a product’s size, features, compatibility or intended use.

4. Pricing

All prices are displayed in Australian dollars unless otherwise stated.

Prices may change without notice. However, a price change will not affect an order that we have already accepted, except where there has been an obvious pricing or system error.

Delivery, installation and other additional charges will be displayed separately where applicable.

Promotional prices, clearance prices and discount codes may be subject to separate conditions and availability periods.

5. Orders and Acceptance

Submitting an order does not automatically mean that we have accepted it.

An order is accepted once we confirm the order and payment has been successfully processed.

We may refuse or cancel an order where:

  • A product is unavailable.

  • Incorrect information was provided.

  • There is an obvious pricing or product-description error.

  • Payment has not been authorised.

  • We reasonably suspect fraudulent or unauthorised activity.

  • We are unable to deliver to the supplied address.

  • The order breaches these Terms.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product and any applicable delivery charge.

We may limit quantities purchased by an individual, household, business, delivery address or account where reasonably necessary.

6. Payment

Orders must be paid using one of the payment methods available at checkout.

You agree to provide accurate billing, contact and payment information and to promptly update this information where necessary.

Your financial institution or payment provider may charge separate transaction, processing or currency-conversion fees. We are not responsible for fees charged independently by your payment provider.

Products remain our property until full payment has been received.

7. Product Availability and Pre-orders

All products are subject to availability.

Stock quantities shown online may not always reflect real-time warehouse stock, particularly where products are sold through multiple sales channels.

Pre-order and back-order products will display an estimated availability or dispatch period where possible. These dates are estimates and may change due to manufacturing, freight, customs, port, transport or other delays outside our reasonable control.

Where a material pre-order delay occurs, we will provide updated information and any options available to you in accordance with applicable law.

8. Delivery

Delivery availability and pricing depend on the product, delivery address and delivery service selected.

Delivery times are estimates and are not guaranteed unless we expressly agree otherwise in writing.

Customers must provide:

  • A complete and accurate delivery address.

  • A working telephone number and email address.

  • Safe and reasonable access to the delivery location.

  • Any access information required by the delivery provider.

You must notify us before delivery of stairs, lifts, narrow doorways, restricted parking, loading restrictions, difficult access or other circumstances that may affect delivery.

Additional charges may apply where:

  • Incorrect delivery information has been provided.

  • Nobody is available to accept a scheduled delivery.

  • Redelivery is required.

  • Access is unsafe or materially different from what was disclosed.

  • Special handling or additional labour is required.

  • An item must be redirected after dispatch.

Unless expressly included in your order, standard delivery does not include assembly, installation, removal of packaging, placement inside a particular room or removal of old furniture.

You should inspect the packaging and products promptly after delivery and contact us as soon as possible regarding visible damage, missing packages or incorrect products.

Nothing in this section limits your rights under the Australian Consumer Law.

9. Warehouse Collection

Warehouse collection may be available from our Carrum Downs, Victoria location by prior arrangement.

Customers must wait until they have received confirmation that the order is ready before attending the warehouse.

Customers collecting an order are responsible for:

  • Bringing an appropriately sized vehicle.

  • Safely securing and transporting the products.

  • Checking the number and condition of boxes before leaving.

  • Arranging sufficient assistance for heavy or bulky items.

Our staff may refuse to load an item where the vehicle or proposed transport method appears unsafe or unsuitable.

Risk associated with transportation arranged by the customer passes to the customer once the products have been collected, except to the extent that loss or damage was caused by us or the product was already faulty.

10. Risk and Ownership

Ownership of a product remains with us until full payment has been received.

For products delivered by us or our delivery provider, risk generally passes to you when the product is delivered to the agreed address.

For warehouse collections, risk generally passes to you when the product is collected.

This section does not affect your rights regarding faulty, damaged, unsafe or incorrectly supplied products.

11. Cancellations

Please contact us immediately if you need to cancel or change an order.

Orders that have not been processed or dispatched may be cancelled for a full refund.

Where an order has already been dispatched, transferred to a delivery provider or booked for delivery, reasonable delivery, redirection, return or cancellation costs may apply to a change-of-mind cancellation.

Pre-orders, custom orders and specially ordered products may not be cancellable once processing, production or procurement has commenced, except where required by law.

We will not charge cancellation fees where the cancellation results from our failure to supply the product or where doing so would conflict with your rights under the Australian Consumer Law.

12. Returns, Refunds and Faulty Products

Returns, refunds, repairs and replacements are handled according to our Returns and Refunds Policy and the Australian Consumer Law.

Clearance, discounted and sale products remain covered by Australian Consumer Law consumer guarantees. However, they may not be returned for change of mind unless our Returns and Refunds Policy expressly allows it.

You may be asked to provide proof of purchase and reasonable evidence of the reported problem, including photographs or videos.

Please do not return products to our warehouse without first contacting us and receiving return instructions.

13. Assembly and Safe Use

Baby furniture must be assembled, maintained and used carefully.

You agree to:

  • Read and follow all supplied assembly and safety instructions.

  • Ensure assembly is completed by a capable adult.

  • Use all required parts, fasteners and safety components.

  • Regularly inspect and tighten fittings where recommended.

  • Stop using a product if it becomes damaged, unstable or unsafe.

  • Use the product only for its intended purpose.

  • Observe all age, weight, mattress-size and usage requirements.

  • Keep plastic packaging and small parts away from babies and children.

For cots and bassinets, only use a mattress with the dimensions and specifications recommended for that particular product. An incorrectly sized mattress may create an unsafe gap.

Do not modify, drill, repaint, remove structural components from or use unapproved replacement parts with a product unless authorised by the manufacturer.

Nothing in this section excludes our responsibility for products that fail to comply with applicable consumer guarantees or safety requirements.

14. Promotions and Discount Codes

Promotions and discount codes:

  • Are valid only during the stated promotional period.

  • Cannot be exchanged for cash.

  • May be limited to selected products or customers.

  • May not be combined unless expressly stated.

  • Must be applied before completing checkout.

  • May be subject to stock availability.

We may cancel or correct a promotion affected by a genuine system, pricing or publication error. Orders already paid will be handled fairly, and any cancelled amount will be refunded.

15. Website Content

The content on our website is provided for general information and shopping purposes.

We may update, correct or remove website content where reasonably necessary. We do not guarantee that the website will always be uninterrupted, error-free or available.

We are not responsible for disruptions caused by maintenance, hosting providers, internet failures, cyber incidents or circumstances outside our reasonable control.

This section does not remove any right or remedy available to you under applicable law.

The remaining provisions will continue to operate.

These Terms are governed by the laws of Victoria, Australia.

You and Little Haven Australia submit to the courts and tribunals with jurisdiction in Victoria, subject to any rights you may have to bring a claim elsewhere under applicable consumer law.
